What Is Authorized Economic Operator Status (YYS)?

It is an international status that provides trusted companies that fulfill customs obligations and meet other general requirements with facilitation and privileges in customs procedures.

Who Can Obtain YYS?

Persons who meet all of the following conditions may obtain Authorized Economic Operator Status (YYS), provided that they apply to the relevant customs administration and are found eligible following the preliminary examination and on-site inspection to be carried out by the customs administration;

  • Being a manufacturer,
  • Being established in the Customs Territory of Türkiye, including Free Zones,
  • Having been operating for at least 3 years,
  • Having carried out transactions under at least 100 declarations in the previous year,
  • Meeting the reliability condition,
  • Meeting the condition that commercial records are reliable and traceable,
  • Meeting the financial solvency condition,
  • Meeting the safety and security condition.

Temporary Restriction on YYS Applications

There is a temporary restriction for companies that may obtain YYS until 31.12.2024. Until this date, at least one of the following conditions must be met;

Within the previous calendar year or within the 1-year period going back from the first day of the month in which the application date falls;

  • Having carried out total exports and imports amounting to at least twenty million US dollars, or,
  • Having carried out exports amounting to at least five million FOB/US dollars, or,
  • Having carried out total imports amounting to at least twenty million US dollars.

Having an industrial registry certificate or an approved capacity report,

Having an expert report containing information on the total power of machinery (HP), number of workers, and production quantity,

For group importers, having a report prepared by a sworn-in certified public accountant showing that at least sixty percent of the imports carried out consist of goods used in the production of group manufacturers,

Having an international carrier authorization certificate obtained from the Ministry of Transport and Infrastructure,

Being designated as a known consignor by the Directorate General of Civil Aviation pursuant to civil aviation legislation,

Having an R&D center certificate issued by the Ministry of Industry and Technology,

Having a certificate issued by the Directorate General of Civil Aviation regarding repair, maintenance, and overhaul activities.

What Are the Simplified Procedures Under YYS?

  1. Permission to submit declarations with missing documents
  2. Partial guarantee authorization
  3. Lump-sum guarantee authorization
  4. Permission to issue ATR certificates under simplified procedures
  5. Permission to issue Invoice Declarations/EUR-MED Invoice Declarations regardless of the value of the goods
  6. Widespread simplified procedure with full declaration, also known as on-vehicle clearance
  7. No requirement to attach documents to export and import declarations 
  8. Ability to submit analysis reports dating back up to six months 
  9. Ability to receive goods before analysis results are obtained 
  10. On-site customs clearance permission for export and on-site customs clearance permission for import
  11. Authorized consignor authorization and authorized consignee authorization

What Are the Facilitations Regarding the Type of Declaration Control Under YYS?

What Are YYS-I and YYS-II Statuses?

In order to provide more facilitations to manufacturing companies engaged in export, subject them to fewer inspections and document controls compared to other companies, and enable customs procedures for inputs contributing to production to be carried out more easily at company premises, YYS-I and YYS-II statuses may be granted to companies that meet the following conditions upon application.

YYS-I

Being a manufacturer + carrying out exports of 5 million USD + employing 50 workers   or    exports of 10 million USD

YYS-II

Being a manufacturer + carrying out exports of 1 million USD + employing 30 workers  or    exports of 5 million USD

What Documents Are Required During the Authorized Economic Operator Certificate Application?

  • Application Form
  • Questionnaire Form, prepared electronically and electronically signed
  • Criminal Record Certificates and Declaration Forms for foreigners (*2 months)  
  • Letter of No SGK Debt (*1 month)            
  • Letter of No Tax Debt (*2 months)
  • Sworn-in Certified Public Accountant Report, covering the last 3 years and concluded positively 
  • ISO 9001 certificate
  • ISO 27001 certificate
  • Signature circular, current
  • Other documents within the scope of temporary restriction

For additional rights and authorizations requested, the relevant documents must also be submitted.

What Is On-Site Customs Clearance Permission for Export?

Provided that all of the following additional conditions are met, companies may be permitted to carry out customs procedures at their own premises without presenting the goods to the export customs office and to dispatch the goods directly to the border customs administration;

a) Having carried out actual exports amounting to at least five million FOB/US dollars within the calendar year preceding the application year or within the one-year period going back from the first day of the month in which the application was registered,

b) Having the necessary equipment and facilities for the storage, unloading, inspection of the goods within the scope of the permission and for taking samples from such goods.

c) Having the necessary equipment for weighing the goods when required at the premises where operations will be carried out under the permission.

  • Export amounts carried out by the applicant through foreign trade capital companies, group exporters, and similar intermediaries are not taken into account
  • In the implementation of on-site customs clearance permission for export, the holder of the permission may transport their goods with any carrier.
  • Certificate holders with on-site customs clearance permission for export are granted Authorized Consignor authorization without any additional request.
  • If the goods are to be transported by a carrier that does not hold Authorized Consignor authorization, the holder must have a Comprehensive Guarantee or Guarantee Waiver Certificate under the Transit Regime within the scope of their Authorized Consignor authorization.

What Is On-Site Customs Clearance Permission for Import?

Persons holding an Authorized Economic Operator certificate may be permitted to carry out import procedures at their approved own premises without presenting the goods to the import customs office, provided that they meet the following additional conditions.

a) Holding YYS-I Status,

b) Having provided a guarantee to the customs administration, no additional guarantee is required if there is a guarantee of 500,000 EUR or a lump-sum guarantee at the maximum amount,

c) Having the necessary equipment and facilities for the storage, unloading, inspection of the goods within the scope of the permission and for taking samples from such goods.

d) Having the necessary equipment for weighing the goods when required at the premises where operations will be carried out under the permission.

  • Certificate holders with on-site customs clearance permission for import are granted Authorized Consignor authorization without any additional request.
  • There must be an area where the goods will be kept within the scope of the permission;
  • Secure Storage Area, indoor area
  • Secure Parking Area, outdoor area
  • The secure area/secure parking area must have the following features;
  • A suitable storage, inspection, and dispatch area.
  • A camera system connected to an uninterruptible power supply, with sufficient resolution to enable vehicle identification and identity verification, and capable of continuously monitoring the secure area 24 hours a day, including entry and exit points.
  • Adequate lighting system.
  • Entry-exit registration system.

Authorized Economic Operator Certificate

  • The certificate becomes valid on the first business day following the date it is issued.
  • Unless any suspension, revocation, or cancellation sanction is applied, the certificate has an unlimited validity period.

What Are the Obligations of Certificate Holders?

The Annex-2 Questionnaire Form Is Updated Once Every 5 Years

The questionnaire form is updated by the certificate holder once every five  years from the date the certificate is issued, prepared to reflect the current status of the certificate holder, and submitted to the Regional Directorate.

Preparation of the Annual Activity Report

At the end of each twelve-month period following the date the certificate is issued, whether the customs procedures carried out under the certificate have been performed duly is documented in an annual activity report by the certificate holder.

The number of declarations to be included in the activity report is determined as at least five percent of the total number of declarations, provided that it is not fewer than fifty declarations.

Being Subject to Preliminary Monitoring Once Every 5 Years

Every five years from the date the certificate is issued, preliminary monitoring is carried out by the regional directorate that issued the certificate through documents related to the verification of certain conditions and through Ministry databases.

The certificate holder is requested to submit certain documents.

Being Subject to Post-Clearance Control

Customs procedures carried out by authorized economic operators are subject to post-clearance control within the scope of the Regulation on Post-Clearance Control and Control of Risky Transactions.
